Disclaimer. It is agreed between the contracting parties with the person who is undertaking completing the psychometric test as indicated with their unique sign in information and their agreement to undertake the test by being informed with the stipulations that appear below. The person completing the test understands the following:
Answering the above clinical psychological questionnaire (“the Questionnaire”) or any of its diverse derivative occupational forms whether in part or in whole is a voluntary act taken by the author of the answers thereto (“the Author”) and that person is free to seek either before or during giving the answers external advice on whether or not to do so.
It is further agreed that neither its creator Richard Sherry nor Psychological Systems Limited nor their servants or agents will be liable for any loss, injury or damage whatsoever or howsoever caused to any individual or partnership or corporation arising from the giving or the use of the answers to the Questionnaire nor for any loss, injury or damage whether mental financial or material or in any other way occasioned by the application by any person or corporation (whether a party to this agreement or not) of the analysis obtained from the answers to the Questionnaire or the learning content or outcome of this psychological material.
It is further agreed that both the answers to the Questionnaire and the analysis of answers there from are the intellectual property jointly and severally of the contracting parties and it is further agreed that both the answers to the Questionnaire and subsequent the analysis thereof are strictly confidential to the parties to this contract and neither Richard Sherry nor Psychological Systems Limited nor their servants or agents will disclose any information obtained from the questions asked the answers given or the resulting analysis to any person or body who is not party to this contract without the consent of each other party hereto.
It is further agreed as a condition precedent that any information as is given to a person or corporation other than a party to this contract shall have any identification or any clue leading to the identity of the Author first redacted by the donor.
Subject to paragraph Four above it is further agreed and understood that the answers to the Questionnaire and any deductions there from may be retained and used by Richard Sherry and or Psychological Systems Limited for research purposes.
Jurisdiction. It is further agreed that the law applying to this contract is the law of England and Wales and it shall be in courts only of that jurisdiction that any dispute arising out of this contract shall be heard.
